The ATRIA Building Products, Inc. LIMITED WARRANTY
This warranty effective for windows sold January 1, 2004 and after. (For windows sold prior to January 2004 or M/I Homes sold after September 16, 2007), please refer to the written window warranty provided by the builder. Copies of these warranties are on file at Atria and are available by request.
Thank you for selecting Atria quality products to add beauty and energy savings to your home. It is our desire to supply the finest quality products possible. We believe giving security to the end users of our products in the form of this excellent warranty, adds even more value for our customers.
Subject to the conditions, exclusions and limitations that follow, Atria Building Products, Inc. (Atria), the manufacturer of VinylTech 2000, VinylTech 3000, HI-D 2500 and TimberCrown™ products, warrants these products to be free from defects in material and workmanship as follows:
Twenty Year Warranty on VEKA® Vinyl
VEKA Inc. the extruder of the vinyl products used in Atria manufactured windows, warrants their rigid vinyl extrusions to be the finest quality available and to be superior for interior and exterior applications. VEKA Inc. warrants that their rigid vinyl extrusions will not chip, peel, blister, rot or corrode when used in the manufacturing of windows and doors as per the instructions of The VEKA Inc. Fabrication Manual. VEKA Inc. does not warrant against uniform fading or color change due to normal weather conditions as normal weathering will cause any surface to gradually fade or darken. This warranty is for a period of 20 years from the date of manufacture. Should any defective material be found during the warranty period, VEKA Inc. will replace the defective material free of charge. This warranty does not cover liability for incidental or consequential damages for any cause whatsoever. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR USE.
Twenty Year Warranty on Insulated Glass Seal
Atria warrants, subject to the conditions and restrictions contained below, that each insulating glass unit shall be free from defects in materials or workmanship for a period of 20 years from the date of manufacture.
Should there be such failure of the air seal within the warranty period, Atria shall provide either a replacement piece of insulated glass or a sash glazed with insulated glass, at its discretion, delivered to the original point of purchase, or, if it is shipped direct to a customer, normal shipping and handling charges will apply. The customer will be responsible for installation and replacement of the glass. Atria will not be responsible for repairing, refinishing or similar activities involved in the installation and replacement of glass. Replacement glass is warranted for the remainder of the original warranty.
Should an insulating glass unit be proven defective during the first ten (10) years of the warranty period, no charge will be made for providing replacement glass or a sash glazed with insulated glass at Atria’s discretion. For Atria products installed in Central Ohio, Atria’s factory service department will not charge labor to replace seal failed glass in the field for a period of two (2) years after purchase. For Atria products installed in Central Ohio, within the ten (10) year warranty period, there will be no charge for glass or labor to replace defective glass in sashes brought to be glazed at the Atria factory. Thereafter, up to 20 years, Atria will offer for purchase, replacement insulating glass at 50% off the current Atria selling price.
This warranty does not apply to, and Atria will not be liable for, glass cracking, shattering, breaking, or scratching, however caused, and it will not apply to any installations where loading applied to the unit could be expected to exceed the structural performance rating of the unit, including structural setting. This warranty also will not apply to any installations at an altitude over 3,500 feet above sea level unless breather tubes have been installed. Insulated units for installations at an altitude over 3,500 feet, or any glass having breather tubes, will not be argon filled.
The effectiveness of an inert gas is not warranted. Aftermarket film application voids this warranty. Atria is not liable for fading of household furnishings including, but not limited to furniture, drapes, and artwork.
Condensation of the interior (room side) glass surface is a sign of excessive humidity as related to interior and exterior temperatures. It is not a product defect. Atria is not responsible for its remedy. The remedy is to reduce the relative humidity. ATRIA IS NOT RESPONSIBLE FOR ANY DAMAGES CAUSED BY CONDENSATION WHATSOEVER.
Ten Year Warranty on Insulated Art Glass
Atria, as manufacturer, warrants all art glass insulated by Atria to the original consumer from failure of the air seal for ten (10) years from the date of manufacture. Atria shall provide either a replacement piece of insulated art glass or reseal the insulated art glass, at their discretion. This warranty does not include cracked or broken glass or damage to the product resulting from accident, abusive handling or misuse or shattering due to heat buildup. The consumer will be responsible for shipping, installation and replacement of the glass. The consumer will be responsible for repainting, refinishing or similar activities involved in the installation and replacement of glass. The consumer will be responsible for any damage to the art glass as result of seal failure including, but not limited to water stains on the art glass or chalking of the metals.
Small specks of dust, dirt, solder or other matter, or minor scratches less than 1" in length are considered allowable manufacturing variances. Leaded glass and its components are handcrafted items. Variations in the angle of the beveled edges and texture or color of the glass or bevels is a natural part of the craft and is not considered a defect. The interior metals may vary in color over time. This is natural oxidation and not considered a defect.
Ten Year Warranty on VinylTech 2000 and TimberCrown™ Component Hardware /
Two Year Warranty on VinylWood 3000 and TimberCrown™ Wood Parts
Atria warrants that its VinylTech and TimberCrown™ product line window component hardware including locks, block and tackle balances, casement operators, hinges, and crank handles, shall be free from defects in material and workmanship for a period of ten (10) years from the date of manufacture. Atria warrants the VinylTech 3000 and TimberCrown™ wood parts shall be free from defects in material and workmanship for a period of two (2) years from the date of manufacture. Natural wood blemishes such as knots, and/or color differences or stain absorption differences and damage caused by condensation is not considered a defect. Atria’s obligation under this warranty shall be limited to, at its option, repair of, provision of replacements for, or refund of the original purchase price of, any product or part which it determines to be defective in material or workmanship under normal use and service. Decisions as to whether to repair, replace, or refund shall be made by Atria in its sole discretion.
Installation and Care Information
All remedies mentioned herein are valid only when products covered by this warranty are properly installed, finished and maintained. There are additional exclusions which apply to this product in the Installation and Care Information leaflet. If you have not received a copy of this leaflet, it is available on line at www.atriawindows.com. Atria will not be liable for any product which has been damaged by normal wear and tear, accident, acts of God, mishandling, improper use, negligent operation, improper installation, alteration, misapplication, faulty building construction or design, exposure to the elements or conditions beyond published performance specifications, storage, condensation, improper maintenance or service including, but not limited to, obstruction of weep holes. Also excluded from the above warranties are failures or operating difficulties resulting from use of expanding foam insulation or incompatible sealant or cleaning agent, exposure to corrosive, unusual, harmful or aggressive substances, fume or condensates (including exposure within 2 miles of salt water), subjection to abnormal stress from localized application of heat, excessive vibration or movement of building or foundations or to other abnormal physical stress or use in ships, boats, watercraft vehicles, trailers, campers, saunas, swimming pools, greenhouse enclosures or other high humidity areas. Selection and purchase of Atria products which conform to all applicable building codes and local ordinances is the sole responsibility of the architect, building contractor or homeowner and Atria assumes no responsibility for compliance or for calculation and design of support mullions, structural support, or flashing required for installation. Consult with your local building code officials and/or a qualified contractor, architect or engineer for specific requirements. All disclaimers and exclusions contained herein apply under all conditions.
General Warranty Information
This warranty applies only to products manufactured completely by Atria Building Products, Inc.
Painting or staining of vinyl parts or weatherstrip of Atria products will void any warranty with respect to the related window product.
Screens are for insect protection only. They are not designed to provide safety, including, but not limited to restriction of children or providing security. Selection of products conforming to all applicable laws, ordinances, building codes, and safety glass requirements are the responsibility of the architect, building owner, and/or the contractor. Atria assumes no responsibility for the placement of its products.
The warranties provided herein shall not apply when Atria is furnishing products or parts in a size which is greater in width or height than the largest standard size shown for that product line in Atria’s printed price catalog for VinylTech or TimberCrown™ products.
Replacement parts will be the closest equivalent current product or part and may not match the original. Replacements will be delivered to the original point of dealer purchase, with no shipping charges. If shipment of replacement product or parts direct to the customer is requested, normal shipping and handling charges will apply. In cases relating to hardware, the customer will be invoiced for the replacement hardware at the list price and appropriate credit will be issued when the defective hardware has been returned to Atria. Supplying replacement products or parts shall not extend the time period of the warranty and the replacement product or part shall be warranted only to the extent of the un-expired portion of the warranty period on the originally purchased product or part.
This warranty applies only to products finished, installed and operated in accordance with Atria’s instructions.
Atria will not, under any circumstances, be responsible for installation, repainting, refinishing or other similar activities necessary to complete any replacement. It will be the customer’s responsibility for installation, repainting, refinishing or other similar activities necessary to complete any replacement.
Atria may require proof of the date of purchase of any product, so you should retain your sales slip or invoice.
Weathering is normal and does not indicate a product defect and therefore is not covered by this warranty.
Natural variations in color, stain properties, or texture of woods are not defects. We suggest that all millwork be inspected upon arrival and before installation and finishing. A good quality top coat of paint, sealer or varnish must be applied to all exposed wood surfaces. The top coat should be applied as recommended by the paint manufacturer. This warranty will not apply if a good quality top coat is not applied within thirty (30) days after purchase. It is the customer’s responsibility to properly care for and protect woodwork against moisture or excessive dryness. This warranty will not apply if the woodwork is not so protected.
The ATRIA Building Products, Inc. Limited Warranty does not cover Atria products that are installed with parts (whether manufactured by Atria or by others) that have not been approved by Atria for installation with that product. Nor does this warranty cover Atria products that are stacked or mulled with half circles, direct-sets or transoms manufactured by others.
Limitation on Liability
THE EXPRESS WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY AND ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH OTHER WARRANTIES TO THE EXTENT PERMITTED BY LAW, ARE HEREBY DISCLAIMED AND EXCLUDED BY ATRIA. ANY IMPLIED WARRANTIES WHICH ARE NOT EXCLUDED HEREBY DUE TO OPERATION OF LAW ARE LIMITED INDURATION TO THE PERIOD OF COVERAGE OF THE EXPRESS WARRANTY PROVIDED HEREIN FOR THE PRODUCT WARRANTED. THE REMEDIES SET FORTH ABOVE ARE THE SOLE AND EXCLUSIVE REMEDIES PROVIDED HEREUNDER, AND ATRIA SHALL NOT BE LIABLE FOR COSTS OF SHIPPING, APPLICABLE TAXES OR ANY OTHER INDIRECT, SPECIAL INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, THE PAYMENT OF ANY COSTS OR EXPENSES OF DISASSEMBLY, REMOVAL OR REINSTALLATION OF ANY PRODUCT OR PART, INCLUDING, WITHOUT LIMITATION, THE INSULATED GLASS, ANY COSTS OR EXPENSES RELATING TO PAINTING, STAINING OR ANY OTHER ACTIVITY NECESSARY IN FINISHING THE REINSTALLATION OR DAMAGE OR LOSS TO OTHER PROPERTY.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation on the duration of any implied warranties not excluded hereby due to the operation of law, may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
No distributor, dealer or representative of Atria has the authority to change or modify this warranty, either orally or in writing, in any respect. Any attempt to change and/or modify this warranty by a distributor, dealer, or representative of Atria will be without legal effect.
